As an artist and political advocate, Robert Bery is both talented and dedicated. He made great strides in 1993 when he led a legal crusade, successfully challenging a NYC statute prohibiting communication of artist in the public forum. Equally impressive is his work of reflective photography. Each photo possesses an exquisite beauty and all maintain perfect balance and form. His signature Duraclear prints have a clarity and boldness that bring the subject matter to life. Yes, Robert creates some very fine artworks, but he did not “lead” the legal crusade culminating in the Bery v City of NY case. He was the lead PLAINTIFF in the prevailing federal case. To set the record straight, I was the lawyer who took on the fight for street artists in 1993. The challenge started in Criminal Court. I had advised Robert of my belief that arrests for unlawful vending were unconstitutional and promised to represent him in the event of his arrest or summoning. I defended him and many other artists in Criminal Court, organized a group of “street” artists, and led protests. I also obtained a City Council Hearing on the issue. I ultimately brought the seminal action in the Southern District of NY, with the assistance of another attorney versed in federal civil law. The judge ruled against us, but the federal appeals court reversed her decision and the US Supreme Court refused to hear the case. The ruling has wide protective implications for all artists in the US.
